  • To: Mayor Rubio, Police Chief, Seaside City Council, My name is Lee Durley and I have lived in this area for over 40 years, mostly in Seaside. I just want to take a moment to acknowledge and commend the Seaside Police department and paramedics. On Sunday November 27, 2016, I was hosting a music event at EMBASSY SUITES which we have presented on the last Sunday of each month for over twenty years. The event was well attended and there was a seemingly mentally disturbed gentleman causing a disturbance and the police were called to have him leave. Despite this gentleman`s defiance and uncooperative attitude, the officers were efficient, patient, courteous and compassionate while dealing with this delicate, totally unpredictable and possibly volatile situation. After the incident was diffused the crowd applauded the police and paramedics and deservedly so. In today`s environment it is refreshing to know that the folks who protect and serve us do it with dignity, professionalism and kindness. I am sure I speak for all of the attendees in saying that everyone recognized and appreciated their noble efforts and we wish all of them and all of you a wonderful and safe holiday season.     Had another run in with officer Hernandez on 3/17/17, the only time the cops ever put their hands on me is when this guy is around. Delt with officers about once or twice a month for years and the three times I ever have a problem Hernandez is involved. Complaints are "filed" but somehow an officer that was directly involved always seems to find a way into the mix and shuts it down. Every other officer just asks a few questions and moves on, not Hernandez. My cell phone was taken out of my hand as I was calling my attorney, cloned, then returned when I was in handcuffs and could no longer ues it. My attorney has the incident recorded on his voicemail and not at all pleased with them denying me access to legal council. As I understand it I have the RIGHT to contact my attorney at ANYTIME when dealing with law enforcement. When I called to file a complaint Hernandez picked up the phone and offered to take the report, like taking a complaint about youself was an appropreate thing to do. There was no crime committed on my behalf with the 3/17 incident and I was not arrested. The seaside PD is out of controll!! I had a run in with officers Hernandez and Owen where I was beaten and tased excessively. When their supervisor Borges showed up I called them a bunch of "A*******" for the excessive tasing. Borges then hands his taser to Hernandez, telling Hernandez to set it on low. Hernendez then tased me in the head while sitting handcuffed in the back of the cop car. I asked my public defender to bring the pictures from the dash cam and tasers to the trial coroberating what I was accusing the cops of, but somehow that didn't happen. After getting free I went to the department to file the first of several complaints and guess who insisted on taking the report, BORGES! So we now have the police committing two crimes, unessesarily beating a civilian and deliberately covering it up. Because the first thing Borges is going to do is go to his boss and say "I just tased a guy in the head for sitting calmly and handcuffed in the back of the car" . I demand this matter be investigated!! Where is the dashcam footage and tasers have a camera, where are these images? If they do manage to show up, they will show the 10 times I was tased did not even close to the 2 times they are saying in the report. Not to mention I was calmly sitting in the back of a squad car in hand cuffs when I was tased in the HEAD! You can't expect theses cops to turn themselves in, Borges, Hernendez, and Owen need to move on. Their time on the force has corrupted their sense of right and wrongand I believe this presents a very clear danger to the public. The Seaside police department has done nothing when I bring up these very serious accusations showing how serious they take the oath "protect and serve". In this case I think "protect and serve, your own" is more appropriate.
